Article 1 – Seller’s identity

KAZARTT is a brand operated by Double T Distribution.

Article 2 – Purpose and scope

These Terms and Conditions of Sale, hereinafter referred to as the “Terms”, define the rights and obligations of Double T Distribution and any natural person acting as a consumer, hereinafter referred to as the “Customer”, in connection with the sale of products offered on the Website.

They apply to all orders placed through the Website and delivered in France or abroad.

Orders placed by professional customers may be subject to separate commercial terms.

The applicable Terms are those in force on the date the order is placed. Customers may review them before ordering and are encouraged to retain a copy.

Article 3 – Acceptance of the Terms

Before confirming an order, the Customer acknowledges having read and accepted these Terms without reservation by ticking the relevant box.

Confirmation of the order and payment constitute full and unconditional acceptance of these Terms.

The Customer confirms that they have the legal capacity required to enter into the contract. Where the Customer acts on behalf of a third party, they warrant that they are authorised to bind that person.

Article 4 – Product characteristics

The essential characteristics of each product are described on its product page, including the model, materials, dimensions, colours, patterns, adjustment system and instructions for use.

The Customer must review this information before placing an order.

Photographs and videos are provided to represent the products as accurately as possible. However, slight variations in colour, grain, finish or engraving may occur due to:

  • the natural characteristics of leather;
  • the handcrafted production process;
  • the settings and characteristics of the screen used;
  • minor differences between production batches.

Such variations do not constitute a defect where they do not affect the product’s essential characteristics, quality or normal use.

All offers are subject to product availability.

Article 5 – Prices

Prices are stated in euros.

For orders subject to French or European VAT, prices are displayed inclusive of all taxes at the rate applicable on the date of the order.

Delivery charges are not included in the product price unless a free-delivery offer applies. Their amount is displayed before the order is confirmed and paid for.

Double T Distribution reserves the right to change its prices at any time. Products will nevertheless be invoiced at the price displayed when the order is confirmed.

Promotional codes, discounts and special offers are subject to the terms stated when they are advertised. Unless otherwise specified, they may not be combined.

A manifest pricing error resulting, in particular, from a technical issue shall not require Double T Distribution to supply a product at an obviously incorrect or unreasonably low price. In such circumstances, the Customer will be informed and may either confirm the order at the corrected price or cancel it and receive a refund.

Article 6 – Ordering process

To place an order, the Customer selects the desired product or products and adds them to the basket.

Before payment, the Customer may review:

  • the selected products;
  • their quantities;
  • their prices;
  • any applicable discounts;
  • the delivery address;
  • the delivery method;
  • the delivery charges;
  • the total amount of the order.

The Customer may correct any errors before finally confirming the order.

The order becomes final after:

  1. reviewing the basket;
  2. providing the information required for delivery and invoicing;
  3. accepting these Terms;
  4. confirming the order with an obligation to pay;
  5. obtaining payment authorisation.

Double T Distribution will then send the Customer a confirmation email summarising the essential details of the order.

The Customer must verify that the information provided is accurate and promptly report any error.

Double T Distribution may refuse or cancel an order for legitimate reasons, particularly in the event of:

  • a payment incident;
  • suspected fraud;
  • an unresolved previous dispute;
  • product unavailability;
  • a clearly incorrect or incomplete address;
  • an inability to deliver to the requested area;
  • an unusually large quantity suggesting a resale activity.

Where an order is cancelled after payment, all amounts paid will be refunded.

Article 7 – Product availability

Products are offered subject to availability.

In the exceptional event that a product becomes unavailable after the order has been confirmed, the Customer will be informed as soon as possible.

Where possible, the Customer may choose to:

  • wait for the product to be restocked;
  • select an equivalent product;
  • cancel the unavailable product;
  • cancel the entire order.

In the event of cancellation, the relevant amount will be refunded using the payment method used for the order.

Article 8 – Payment

The full price is payable when the order is placed.

The payment methods actually available are those displayed at checkout. These may include payment cards, PayPal and certain electronic wallets.

Payments are processed by secure payment service providers. Double T Distribution does not retain the Customer’s full bank card details.

The Customer warrants that they are authorised to use the selected payment method.

If payment is refused, bank authorisation is not obtained or fraud is suspected, the order may be suspended or cancelled.

Article 9 – Delivery charges

Delivery charges are calculated automatically according to:

  • the destination country;
  • the selected delivery method;
  • the characteristics of the order.

The exact amount is displayed before payment is confirmed.

Delivery is free when purchasing two or more belts for orders shipped to eligible European destinations served by KAZARTT.

The application of this offer is displayed automatically in the basket or at checkout.

For the purchase of a single belt and for orders shipped outside the eligible European area, delivery charges are payable by the Customer and are displayed before payment.

Article 10 – Preparation, dispatch and delivery

Orders are prepared and dispatched from Belgium or France.

Orders placed before 1.00 pm are generally dispatched the same day, Monday to Friday. Orders placed after 1.00 pm, during the weekend or on a public holiday are generally processed on the next working day.

These timeframes are usual preparation estimates and do not constitute a guarantee of same-day dispatch.

Depending on the destination country and the selected delivery method, delivery generally takes between 1 and 7 working days.

The applicable delivery timeframe or estimate is communicated to the Customer during the ordering process.

An email containing a tracking link will be sent as soon as tracking information is made available by the carrier.

Available carriers may include Colissimo and Mondial Relay. The carriers offered may vary according to the destination.

The Customer must provide a complete and accurate address. Double T Distribution shall not be liable for delays resulting from incorrect or incomplete information supplied by the Customer.

The risk of loss or damage to the products passes to the Customer when the Customer, or a third party appointed by them other than the carrier, takes physical possession of the parcel.

In the event of a significant delay, the Customer may contact customer service so that an enquiry can be opened with the carrier.

If the order is not delivered within the announced timeframe, the Customer is entitled to the remedies provided for under the French Consumer Code, including the right to require delivery within a reasonable additional period and, if the order is still not delivered, to terminate the contract.

Article 11 – Inspection of the order upon receipt

Upon receipt, the Customer is encouraged to check:

  • the external condition of the parcel;
  • the number of products received;
  • whether the products correspond to the order;
  • whether there is any visible damage.

In the event of a damaged or incomplete parcel, an incorrect product or any other issue, the Customer should promptly contact customer service, provide the order number and, where possible, include photographs.

This inspection does not affect the Customer’s rights under the statutory guarantees.

Article 12 – Deliveries outside the European Union

For deliveries outside the European Union, customs duties, import taxes or administrative charges may be imposed by the authorities in the destination country.

Where these charges are not expressly included and collected at checkout, they remain payable by the recipient.

Double T Distribution does not determine the amount of such taxes and recommends that the Customer contact the customs authorities in their country before placing an order.

Refusal to pay import duties or taxes does not automatically entitle the Customer to reimbursement of costs incurred for the shipment and return of the parcel, without prejudice to the Customer’s mandatory legal rights.

Article 13 – Statutory 14-day right of withdrawal

In accordance with the French Consumer Code, the Customer has 14 calendar days from receipt of the product to exercise the statutory right of withdrawal without having to provide a reason.

Where several products forming part of the same order are delivered separately, the period begins upon receipt of the final product.

To exercise this right, the Customer must send, before the expiry of the period, an unambiguous statement expressing the decision to withdraw:

  • by email to hola@kazartt.com;
  • by post to Double T Distribution, 1491 avenue Octave Butin, 60280 Margny-lès-Compiègne, France;
  • or by using the standard withdrawal form at the end of these Terms.

The Customer then has 14 days from the date on which the withdrawal decision is communicated to return the product in accordance with the instructions provided.

The direct cost of returning the product is payable by the Customer, except where the product is defective, damaged or different from the product ordered.

The Customer may handle the product only to the extent necessary to establish its nature, characteristics and proper functioning. The Customer may be liable for any reduction in value resulting from handling beyond what would normally be permitted in a shop.

The absence of the original packaging does not automatically remove the statutory right of withdrawal. However, the Customer must adequately protect the product during transport.

In the event of a valid withdrawal, Double T Distribution will refund:

  • the price of the returned product or products;
  • the standard delivery charges initially paid for the order.

Any additional costs resulting from the Customer choosing a delivery method more expensive than the standard option will not be refunded.

The refund will be issued no later than 14 days after notification of the withdrawal. Double T Distribution may withhold the refund until the product has been recovered or until the Customer supplies evidence that it has been sent back, whichever occurs first.

The refund will be made using the same payment method used for the order, unless the Customer expressly agrees otherwise.

Article 14 – Exceptions to the right of withdrawal

The right of withdrawal may not be exercised in the circumstances provided for by Article L.221-28 of the French Consumer Code.

It is excluded in particular for products:

  • made to the Customer’s specifications;
  • clearly personalised;
  • irreversibly altered at the Customer’s request;
  • unsealed after delivery where they cannot be returned for health-protection or hygiene reasons, where this exception is legally applicable.

Adjusting or shortening a belt by the Customer after receipt may make it unsuitable for resale. It may result in a significant reduction in value or prevent its acceptance under the commercial return extension set out in the following article.

Article 15 – Commercial extension of returns to 30 days

In addition to the statutory 14-day right of withdrawal, KAZARTT allows the Customer to request a return within 30 calendar days of receiving the order.

For requests submitted between the 15th and 30th day, this extension constitutes a voluntary commercial policy.

The product must be:

  • unworn;
  • unused;
  • not shortened or altered;
  • clean and undamaged;
  • complete with its accessories;
  • returned, where possible, in its original packaging;
  • in a condition allowing it to be resold as new.

Return delivery charges are payable by the Customer.

For return requests submitted between the 15th and 30th day:

  • the price of the product accepted for return will be refunded;
  • the original delivery charges will not be refunded;
  • the return delivery charges will not be refunded.

This commercial extension does not apply to:

  • personalised products;
  • products that have been altered, shortened or irreversibly adjusted;
  • gift cards that have already been used, even partially;
  • products that can no longer be resold as new.

Article 16 – Returns procedure

Before returning any product, the Customer must contact:

The request must include:

  • the Customer’s first and last name;
  • the order number;
  • the email address;
  • the product concerned;
  • the nature of the request;
  • where applicable, photographs of the product or parcel.

Double T Distribution will provide the return instructions and the address of the appropriate returns centre.

As products may be returned to France or Belgium depending on the destination and circumstances, no parcel should be sent before the Customer has received the return instructions.

The Customer must package the product securely. The Customer is advised to use a tracked delivery method and retain proof of postage until the request has been fully processed.

Article 17 – Defective, damaged or incorrect products

Where a product received is defective, damaged or different from the product ordered, the Customer must contact customer service before returning it.

After verification, Double T Distribution will provide the necessary instructions and cover the return delivery charges where the defect or error is attributable to it.

Depending on the circumstances and the Customer’s rights, a repair, replacement, price reduction or refund may be offered.

Article 18 – Statutory guarantees

Products are covered by the statutory guarantee of conformity and the statutory guarantee against hidden defects.

Statutory guarantee of conformity notice

The consumer has a period of two years from delivery of the goods in which to invoke the statutory guarantee of conformity if a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it arose.

The statutory guarantee of conformity entitles the consumer to have the goods repaired or replaced within 30 days of their request, free of charge and without significant inconvenience.

Where the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

Where the consumer requests the repair of the goods but the seller requires replacement, the statutory guarantee of conformity is renewed for a period of two years from the date on which the goods are replaced.

The consumer may obtain a reduction in the purchase price while retaining the goods or terminate the contract and receive a full refund in exchange for returning the goods if the professional refuses to repair or replace them, if repair or replacement takes place more than 30 days after the request, if bringing the goods into conformity causes significant inconvenience or if the lack of conformity remains despite an attempt to bring the goods into conformity.

The consumer may also immediately obtain a price reduction or terminate the contract where the defect is sufficiently serious. However, the consumer may not terminate the sale if the lack of conformity is minor.

The consumer also benefits from the statutory guarantee against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code for two years from discovery of the defect. This guarantee entitles the consumer to a reduction in price if the goods are retained or to a full refund in exchange for returning them.

The Customer must provide the order number and any information useful for identifying the defect.

Invoking the statutory guarantee of conformity is free of charge for the Customer.

Article 19 – Liability

Double T Distribution is responsible for the proper performance of its contractual obligations, including where certain services, particularly delivery, are entrusted to service providers.

It shall not, however, be liable where the failure or improper performance results from:

  • an act or omission by the Customer;
  • abnormal or improper use of the product;
  • an alteration made to the product by the Customer;
  • an unforeseeable and unavoidable event attributable to a third party;
  • an event of force majeure recognised under French law.

Double T Distribution shall not be liable for normal wear of the leather or deterioration caused by improper care, excessive exposure to water, heat, chemicals or any other conditions contrary to the care recommendations.

Nothing in these Terms limits the Customer’s mandatory rights or the seller’s liability in the event of personal injury, gross negligence or fraud.

Article 20 – Intellectual property

The elements appearing on the Website, including:

  • the KAZARTT trademark;
  • logos;
  • texts;
  • photographs;
  • videos;
  • illustrations;
  • patterns;
  • graphics;
  • the structure and content of the Website,

are protected by intellectual property laws.

Any reproduction, representation, adaptation, use or exploitation, whether total or partial, without prior written authorisation is prohibited, except where permitted by law.

The purchase of a product does not confer any intellectual property rights over the brand’s designs, patterns or other elements.

Article 21 – Personal data

Personal data collected during the ordering process is used in particular to:

  • process and deliver orders;
  • manage payments;
  • provide after-sales service;
  • prevent fraud;
  • comply with accounting and legal obligations;
  • send marketing communications where the Customer has consented or where permitted by law.

The processing arrangements, retention periods, recipients of the data and the Customer’s rights are detailed in the Website’s Privacy Policy.

Subject to the conditions laid down by applicable legislation, the Customer has rights of access, rectification, erasure, restriction, objection and data portability.

The Customer also has the right to lodge a complaint with the French data protection authority, the CNIL.

Article 22 – Evidence and archiving

Computerised records retained in the systems of Double T Distribution and its service providers constitute evidence of communications, orders and payments between the parties, unless proven otherwise.

Contracts concluded electronically for an amount equal to or greater than €120 are archived for the applicable statutory period. The Customer may request access by contacting customer service.

The Customer is encouraged to include the order number to facilitate the processing of the request.

Article 24 – Consumer mediation

In the event of a dispute, the Customer must first submit a written complaint to customer service in an attempt to reach an amicable solution.

If the Customer is not satisfied with the response, or if no response is received within a reasonable period, the consumer may refer the dispute free of charge to the consumer mediator appointed by Double T Distribution.

Article 25 – Applicable law and jurisdiction

These Terms and contracts concluded through the Website are governed by French law.

Where the Customer resides in another European Union country, this choice of law does not deprive the Customer of the mandatory consumer-protection provisions applicable in the Customer’s country of residence.

In the event of a dispute and after an attempt at amicable resolution, the competent courts will be determined in accordance with the applicable legal rules.

Nothing in these Terms may require a consumer to bring proceedings before a court that would not have jurisdiction under applicable law.

Article 26 – Severability and amendment of the Terms

If any provision of these Terms is declared invalid, unlawful or unenforceable, the remaining provisions will remain in force.

Double T Distribution may amend these Terms at any time. Amendments will not apply retroactively to orders that have already been confirmed.

The Terms applicable to an order are those accepted by the Customer when the order was placed.
